The Ironworks Gymnasium Ltd Terms & Conditions

1. Commencement of Agreement

This membership agreement will come into effect once we contact you to confirm your membership registration. At that point, a binding contract will be established between you (the "Member") and us (the "Gym").

2. Rights and Privileges

As a member, you will be entitled to all the rights, benefits, and privileges associated with the membership plan you have selected. These rights are exclusive to the member and are subject to the terms outlined in this agreement.

3. Non-Transferability

Your membership is strictly personal and non-transferable. You are not permitted to assign or transfer your membership rights, privileges, or obligations to any other individual, whether temporarily or permanently.

4. Payment Terms

  • Initial Payment: The membership fee for the first month will be collected upon sign-up either via Debit or Credit Card at the time of purchase or by Direct Debit. The Direct Debit payment for the first month will be processed approximately 5 working days after the membership application date.

  • Subsequent Payments: After the first month, membership fees will be automatically collected monthly via Direct Debit on the same day of the month as the initial payment.

  • Non-Refundable: All payments made under this agreement are final and non-refundable under any circumstances.

5. Non-Payment of Fees

If any Direct Debit payment is returned as unpaid, or if any other method of payment is not honoured for any reason, we reserve the right to either suspend or terminate your membership without prior notice.

6. Change of Member Information

You agree to inform us immediately of any changes to the personal details you provided during registration, including contact information, payment details, or any other relevant information.

DIRECT DEBIT PRICES AND CHANGES

Price Increases Occasionally, we may need to increase the membership price. If this happens, we will provide you with at least one full month’s notice before the new price takes effect. The notice will include the new membership cost and the exact date the increase will be applied. During this notice period, you have the right to terminate your membership in accordance with the cancellation terms outlined in this agreement. If you choose not to cancel by the specified date, the new membership price will automatically apply to your account.

MONTHLY DIRECT DEBIT MEMBERSHIPS

Minimum Term of Membership The minimum membership term is one full calendar month starting from the date you sign up. After this minimum term, your membership will continue on a rolling monthly basis, with payments automatically processed via Direct Debit. For 12-month memberships you will be required to see out the full term of your membership this is defined as “the minimum term” after that term it will revert to a month-to-month membership.

2. Termination of Membership

  • You may cancel your membership after the minimum term by:

  • Cancelling your Direct Debit: Contact your bank and request the cancellation, ensuring that they have 4 working days to process the cancellation.

  • Notifying the Gym: You must also send a termination email to us at ironworksgymnasium@gmail.com to confirm your intent to cancel.

  • Your membership will remain active until the day before your next payment is due, at which point it will terminate without further charges.

QR CODE ABUSE POLICY

1. Personal Use of QR Code Your QR Code is issued solely for your personal use. It is tied to your membership and grants you access to the gym. You are responsible for keeping your QR Code confidential and ensuring it is not shared with others.

2. Monitoring and Verification Use of QR Codes will be monitored for security and safety reasons. If requested, you may be asked to provide identification to confirm your identity when using the gym facilities.

3. Consequences of QR Code Misuse If we have reasonable grounds to believe that your QR Code has been used by someone other than you, with or without your knowledge, we reserve the right to take immediate action.  In the event of repeated misuse or if your QR Code has been used by multiple individuals, we will cancel your membership immediately without refund.

  • We will notify you of this action via email and may take further steps to ensure compliance with gym policies.

GENERAL TERMS AND CONDITIONS

1. Minimum Age Requirement

All members must be at least 16 years of age to join the gym and use its facilities.

2. Compliance with Gym Rules

As a member, you agree to comply with all the gym's Rules of Membership, including any updates or modifications made to these rules. Failure to comply may result in suspension or termination of your membership.

3. Enforcement of Terms

If we do not immediately enforce any part of this agreement, it will not prevent us from enforcing it at a later date. Any leniency granted in one instance does not constitute a waiver of our right to strictly enforce the terms of the agreement in the future.

4. Gym Closures

From time to time, we may need to close all or part of the gym for maintenance, upgrades, or other reasons. We will provide reasonable notice of any planned closures, unless it is due to an emergency or urgent situation. While we will aim to minimize disruptions during peak hours, we will not be liable for any inconvenience caused, and you will not be entitled to any refund or reduction of membership fees for these closures.

5. Personal Trainer Liability

We are not responsible for any financial transactions or obligations between you and any Personal Trainer (PT). All payments and arrangements for Personal Training services are made directly between you and the PT, and we do not assume liability for any outstanding payments to them.

6. Breach of Membership

Terms If you breach any of the gym's rules or this agreement, we reserve the right to terminate your membership immediately and without refund. Notification of termination will be sent to you via email.

7. Health and Safety

You confirm that, to the best of your knowledge, you are in good physical health and capable of participating in physical exercise. You agree that engaging in exercise at the gym is not detrimental to your health, and you will notify us immediately if your health or physical condition changes. These terms and conditions are designed to ensure a safe and fair environment for all our members. By signing up, you confirm your acceptance of these detailed terms and agree to abide by them.
